About the 5-Step Simulation Licenses™

LearningSim licenses the 5-Step Simulation™ method and materials to individuals and to organizations. This makes it possible for us to offer people the option of using the ready-made simulations, editing them to fit their needs, or using the material and methods to create their own simulations, while still protecting our ownership of the core ideas and content. Our license works exactly the same way as a software license--you are paying for the right to use the information we provide within a legally-defined set of boundaries. The type of license you choose determines the boundaries and flexibility you have with the material.

License Types

There are two types of licenses. Each has its own benefits and limitations. Choose the license that is right for your situation and needs. Feel free to contact us if you have license requirements that cannot be met by one of these basic license types. These are the highlights of the licenses. Please see the specific license text for specific legal rights, responsibilities, and requirements.

5-Step Simulation™ Individual User License

Purchase of a 5-Step Simulation™ Individual User license grants a single person a license to use the 5-Step Simulation™ model, reproduce simulations, and to edit and create derivative training products based on the 5-Step Simulation™ model and material that may be used by the user internally for training and education purposes within one organization. The person for whom this 5-Step Simulation™ product is purchased is “the user.”

• This license is not transferrable; the user may not re-sell, give, transfer, or loan the 5-Step Simulation™ material he or she purchased to another person. Once a person becomes a "user" of the material, that uses up one of the licenses purchased.
• This license is for one individual only; the user may not create products or material using the 5-Step Simulation™ model that will be delivered or facilitated by other unlicensed individuals. Each user of the 5-Step Simulation™ method or material must have his or her own user license. (We sell multi-user licenses to make this convenient.)
• The Individual User license is for internal training and education use only; the user may not create products or material based on the 5-Step Simulation™ model that will be used in a third-party organization. (The purpose of the Certified User license is to allow training professionals to use the 5-Step Simulation product for commercial creation and delivery of training to third-party organizations as vendors or consultants. If you purchased the Individual User license but need this type of license, please contact us.)
• This license is for non-commercial training and education use only; the user may not use or create products or material based on the 5-Step Simulation™ model as part of a for-profit sale of training or educational services to another individual, entity, or organization. (That is the purpose of the Certified User license, above.)
• Ownership of derivative works based on the 5-Step Simulation™ model and material is shared by LearningSim and the creator of those derivative works. LearningSim waives all rights to royalties and fees from derivative works. Our partial ownership interest is solely to ensure compliance with our license agreement and safeguard the investment we have made in our intellectual property.
• This license comes with purchase of the 5-Step Simulation™ product and is assumed to be understood and accepted by the purchaser (and any additional users of a multi-user license). Accessing the 5-Step Simulation™ files constitutes acceptance of the license agreement.

• The Individual User license is valid for 5 years from the date of purchase.

5-Step Simulation™ Certified User License

Purchase of a 5-Step Simulation™ Certified User license grants a single person a license to use the 5-Step Simulation™ model, reproduce simulations, and to edit and create derivative training products based on the 5-Step Simulation™ model and material that may be used by the user for commercial training and education purposes within the user's organization and third-party organizations that engage the user's services. The person for whom this 5-Step Simulation™ product is purchased is “the user.”

• This license is not transferrable; the user may not re-sell, give, transfer, or loan the 5-Step Simulation™ material he or she purchased to another person. Once a person becomes a "user" of the material, that uses up one of the licenses purchased.
• This license is for one individual only; the user may not create products or material using the 5-Step Simulation™ model that will be delivered or facilitated by other unlicensed individuals. Each user of the 5-Step Simulation™ method or material must have his or her own user license. (We sell multi-user licenses to make this convenient.)
• The Certified User license allows training professionals to use the 5-Step Simulation product for commercial creation and delivery of training to third-party organizations as vendors or consultants.
• This license allows the user to create products or material based on the 5-Step Simulation™ model for use as part of the training or educational services delivered to another individual, entity, or organization, but does not allow the user to create products for re-sale by the third party. (In other words, the user can sell this to clients, but the clients cannot re-sell the material to others.)
• Ownership of derivative works based on the 5-Step Simulation™ model and material is shared by LearningSim and the creator of those derivative works. LearningSim waives all rights to royalties and fees from derivative works. Our partial ownership interest is solely to ensure compliance with our license agreement and safeguard the investment we have made in our intellectual property. LearningSim makes no claim upon any portions of content added by the user in the process of creating a derivative work.
• This license comes with purchase of the 5-Step Simulation™ product and is assumed to be understood and accepted by the purchaser (and any additional users of a multi-user license). Accessing the 5-Step Simulation™ files constitutes acceptance of the license agreement.

• The Certified User license is valid for 2 years from the date of purchase.
